KARACHI: An anti-terrorism court (ATC) dismissed on Monday the investigation report provided by police that had acquitted Dr Asim Hussain of all terror allegations, ordering the suspect be presented before ATC-II for further proceedings.
Now, Hussain has been handed over to police from the custody of NAB.
The police report was presented in court by investigation officer (IO) DSP Altaf Hussain to content the reason why he was released.
“We did not find any evidence during the course of the investigation,” the DSP told the court, adding the investigation report was sent to the concerned SSP at first for endorsement and then to the concerned DIG and finally got approval from police’s legal team.
Earlier, police had informed the court on December 11 that no terror-related testimony was traced against Dr Hussain under Section 497 (II) of the Criminal Procedure Code (CrPC), which was why he was to be set free from detention.
However, contrary to the statement, the Rangers prosecutor had argued that sufficient evidence was found to implicate Dr Hussain. He said that the IO did not consult the Rangers during the probe in the case in spite of the case being triggered by the paramilitary force.
Following Rangers’ strong opposition to police’s act, the court had asked the police IO to submit a report within 10 days that should explain why no charges could be made against Dr Hussain under the CrPC.
